Indigenous and environmental groups raise concerns about Ontario Bill 140 archaeology changes

Four Indigenous youth-led and environmental advocacy organizations raised concerns in a November 2, 2026 statement about proposed archaeological-protection changes in Ontario's Bill 140. The Ontario Legislature's published bill text confirms proposed changes to archaeological registrations, authorizations and assessments. The groups warn that culturally significant sites could be placed at risk, particularly around the Attawapiskat River and Ring of Fire region. Their assessment of potential harm is an attributed concern, not an established finding of damage or a court ruling.

Education and context: The proposal raises questions relevant to TRC Call #43, concerning implementation of the UN Declaration on the Rights of Indigenous Peoples, and Call #79, concerning Indigenous participation in heritage and commemoration. Neither Call has been shown completed by this development. The bill's introduction does not establish that its proposed amendments are in force.

Accountability: What archaeological assessments would remain mandatory? How would affected First Nations participate in decisions? What safeguards would protect ancestral burial grounds and culturally significant sites? Ontario's response to the organizations' November 2 concerns has not been independently verified.
